Legal Status of a Private Expert Opinion in Turkey
Turkish procedural law expressly allows parties to obtain an expert opinion:
Code of Criminal Procedure (CMK), Article 67
“The public prosecutor, the intervening party, their representative, the suspect or accused, defence counsel or legal representative may obtain a scientific opinion from an expert concerning the subject of the proceedings, for evaluation in the preparation of the court expert’s report, or about the court expert’s report.” (unofficial translation)
Code of Civil Procedure (HMK), Article 293
“The parties may obtain a scientific opinion from an expert concerning the matter in dispute.” (unofficial translation)
Under Article 293(2) HMK, the judge may, on request or of their own motion, decide to hear the expert who prepared the report at a hearing; the judge and the parties may put questions to the expert. An expert opinion filed with the case is evaluated freely by the court together with the other evidence (Art. 198 HMK, Art. 217 CMK).
Parties may therefore consult certified experts on technical questions in their case, obtain an expert opinion and submit it to the court as evidence. This is THEIR LEGAL RIGHT.
